Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Glimmer mobile application ("App") operated by Glimmer ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our App, you confirm that you are at least 13 years old and agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must not use the App.

2. Description of Service

Glimmer is a skincare tracking and routine management application that helps users:

  • Set up and manage personalized skincare routines
  • Receive reminders for skincare applications
  • Track skincare progress through photos stored locally on your device
  • Monitor product expiration dates
  • Access skincare tips and recommendations

The App is intended for informational purposes only and does not provide medical advice. Always consult a dermatologist or healthcare professional for skin concerns.

3. Account Registration

To access certain features, you may need to create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities under your account

4. Subscriptions and Payments

Free and Premium Features

The App offers both free features and premium subscription plans with additional functionality. Premium features are clearly marked within the App.

Billing

Subscriptions are billed through the Apple App Store or Google Play Store. By purchasing a subscription, you agree to the payment terms presented at the time of purchase.

Auto-Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Cancellation

You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Cancellation will take effect at the end of the current billing period. No refunds are provided for partial subscription periods.

Price Changes

We reserve the right to change subscription prices. Any price changes will be communicated in advance and will apply to subsequent billing periods.

5. User Responsibilities

When using the App, you agree to:

  • Use the App only for lawful purposes
  • Not attempt to gain unauthorized access to any part of the App
  • Not interfere with or disrupt the App's functionality
  • Not use the App to transmit harmful code or malware
  • Not copy, modify, or distribute the App's content without permission
  • Not use the App for any commercial purpose without our consent

6. User Content

You retain ownership of any content you create within the App, including photos and routine data. Photos taken within the App are stored locally on your device and are not uploaded to our servers.

You are solely responsible for the content you create and store within the App.

7. Push Notifications

The App may send push notifications to remind you about your skincare routine. You can enable or disable notifications at any time through your device settings or within the App.

8. Intellectual Property

The App, including its design, features, content, and underlying technology, is owned by Glimmer and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

You may not:

  • Copy, modify, or create derivative works of the App
  • Reverse engineer, decompile, or disassemble the App
  • Remove any copyright or proprietary notices
  • Transfer your license to any third party

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

THE APP DOES NOT PROVIDE MEDICAL ADVICE. Any information provided is for general informational purposes only and should not be considered a substitute for professional medical advice, diagnosis, or treatment.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLIMMER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data or content
  • Loss of profits or revenue
  • Personal injury or property damage
  • Any damages arising from your use of the App

Our total liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Glimmer and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

12. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the App will immediately cease. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the App after such changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
